WAIVER AND RELEASE OF LIABILITY
In consideration of the risk of injury while participating in any activity ran by Pride Sports USA, LLC (the “Activity”), and as consideration for the right to participate in the Activity. I hereby, for myself, my heirs, executors, administrators, assign, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waiver any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Pride Sports USA, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.

I am voluntarily participating in the aforementioned activity and I am participating in the activity entirely at my own risk, I am aware of the risk associated with traveling to and from as well as participating in this activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. i understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel, or the condition of the activity location(s). Nonetheless, i assume all related risks, both known or unknown to me, of my participation in this activity, including travel to, from and durning this activity.

By signing this waiver I agree that I will follow all park, facility, city, Pride Sports USAs rules and will follow the code of conduct set by Pride Sports USA. I understanding if I do not follow the rules I can be kicked out of the league and will not receive a refund. I understand alcohol is not allowed at the fields or during games, practices, scrimmages or any form of play. I agree to indemnify and hold harmless Pride Sports USA, LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Pride Sports USA, LLC incurs any of these types of expenses, I agree to reimburse Pride Sports USA.

I acknowledge that Pride Sports USA, LLC and their directors, officers, volunteers, representatives tents and owners are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Pride Sports USA.

Refund Policy- By Signing this waiver, I agree that Pride Sports USA, LLC does not issue refunds. We have a zero refund policy. If a season is canceled or postponed or for any other reason we can issue you a credit. This credit can be used for a future season. If you break a rule durning the season and therefore are kicked out of the league, you will NOT receive a refund or credit.

I acknowledge that this activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions or others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors and/ or producers of the event.

I acknowledge that I have carefully read this “ Waiver and Release” and fully understand that it is a release of liability and release of ownership, I expressly agree to release and discharge Pride Sports USA, LLC and all of its affiliates, managers, members, agents, attorneys, staff, volunteer, umpires, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Pride Sports USA for personal injury or property damage.

I hereby grant Pride Sports USA, LLC permission to use my likeness in a photograph, video, or other digital media(“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of Pride Sports USA, LLC and will not be returned. I hereby irrevocably authorize Pride Sports USA, LLC to edit, alter, copy, exhibit, sell, publish, or distribute these photos for any purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. I also waive any right to royalties or other compensation related to the use of the photos used.

For a period of two (2) years following the date of my last participation in any Program, I shall not, direct or indirectly, develop, create, manage, establish or participate in the development, creation, organization or establishment of any organization, league, tournament or other entity in the United States that engages in events, programs and activities competitive with Pride Sports USA, LLC Programs. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Pride Sports USA, LLC, its agents, employees and work for hires.

In the event that I should require medical care or treatment, I agree to be financially responsible for any and all costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

By signing this waiver, I agree that I have my own personal insurance. Incase of any and all injuries from playing in Pride Sports USA, LLC, programs and will use my own personal insurance and not the leagues.

I understand that I am responsible for all personal and league fines due to but not limited to, consuming of alcohol and the destruction of property, gym, venue, fields.

In the event that any damage to equipment or facilities orders as a result of my to my family’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

This Agreement was entered into at arm’s length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant and Pride Sports USA, LLC agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

In the event that any provisions contained within this Release of Liability shall be deemed to be severable or invalid, or if any terms, conditions, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause served does not affect enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

COVID19-By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending our programs and that such exposure or infection may result in personal injury, illness, permanent disability, and death of me and others close to me. I understand that the risk of becoming exposed to or infected by COVID-19 at our programs may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Pride Sports USA, LLC and other programs brought on by Pride Sports USA, LLC, it’s volunteers, it’s staff and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or anyone in contact with myself, may experience or incur in connection with my attendance or participation in our programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless the Pride Sports USA, LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Pride Sports USA, LLC its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any program.

I, the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely signing this agreement, I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.

Pride Sports USA is committed to the ideals of diversity and inclusion. We believe that every person has the right to feel safe and comfortable being themselves while engaged in organized athletics. As such, we are committed to providing an experience that affirms the dignity and value of all individuals without regard to age, race, ethnicity, national origin, religious or spiritual beliefs, sexual orientation, gender identity, gender expression, socioeconomic status, physical or mental abilities, size, appearance, or any other basis for exclusion.
That commitment is enshrined in the following policies which comprise Pride Sports USA’s Code of Conduct. Violation of any of these policies will subject the violating member to potential disciplinary action. Disciplinary action can include verbal warnings, written warnings, suspensions, and, if the violation is repetitive or particularly egregious, expulsion from the league. If expelled, a member will not be refunded any registration fees. The application of specific disciplinary action will be determined by the managers based on the facts of each specific situation.
These rules apply to all players, officials, spectators and other attendees at Pride Sports USA events.
Anti-Harassment Policy
Pride Sports USA is committed in all areas to providing a sports and social environment that is free from harassment. Harassment is any behavior, motivated by discriminatory animus, that is unwelcome and offensive to the person or persons towards whom it is targeted. Such behavior is expressly forbidden by this policy. All members of the Pride Sports USA community are expected and required to abide by this policy. No person will be adversely affected in terms of their association with Pride Sports USA as a result of bringing forward complaints of harassment.
Sexual harassment is behavior of a sexual nature that is unwelcome and offensive to the person or persons it is targeted toward. Examples of harassing behavior may include unwanted physical contact, foul language of an offensive sexual nature, sexual propositions, sexual jokes or remarks, obscene gestures, and displays of pornographic or sexually explicit pictures, drawings, or caricatures. Sexual harassment of other members of the Pride Sports USA community is expressly forbidden. Additionally, the harassment of non-members attending Pride Sports USA events including volunteers and spectators is also prohibited.
If any member of the Pride Sports USA community feels that they have been harassed on the basis of their age, sex, race, national origin, ethnic background, ability or any other personal characteristic, they should immediately report the matter to a member of the managers of the organization. Once the matter has been reported it will be promptly investigated and any necessary corrective action will be taken where appropriate. All complaints of harassment will be handled in as discreet and confidential a manner as is possible under the circumstances.
Anti-Bullying Policy
Pride Sports USA considers bullying unacceptable and will not tolerate it under any circumstances. This policy shall apply to all members of the Pride Sports USA community. Additionally, the bullying of non-members attending Pride Sports USA events including volunteers and spectators is also prohibited. Any community members found in violation of this policy will be disciplined, up to and including expulsion from the league.
Pride Sports USA defines bullying as persistent, malicious, unwelcome, severe and pervasive mistreatment that harms, intimidates, offends, degrades or humiliates a member, whether verbal, physical or otherwise, at league-sponsored events. The Organization promotes a safe athletic and social culture where all members are able to join in an environment free of bullying behavior.
Pride Sports USA encourages all of its members to report any instance of bullying behavior to a manager of the organization. Any reports of this type will be treated seriously, investigated promptly and impartially, and necessary corrective or disciplinary action will be taken. The Organization will protect any member who reports bullying conduct from retaliation or reprisal.
Pride Sports USA considers the following types of behavior to constitute bullying. Please note, this list is not meant to be exhaustive and is only offered by way of example:
* ●  Staring, glaring or other nonverbal demonstrations of hostility 

* ●  Exclusion or social isolation 

* ●  Personal attacks (angry outbursts, excessive profanity, or name-calling) 

* ●  Encouragement of others to turn against the targeted member 

* ●  Stalking 

* ●  Punching, kicking, slapping or any other unwanted physical contact 
Excessive Drunkenness & Drug Use 
As a member of our collective community, no one should be excessively drunk or participate in any illegal drug activities while at league functions, wearing our league shirt, or operating in any capacity where you are seen as a member of the league. Our league strives to provide a safe, inclusive space for all members. 
Complaints & Disciplinary Action 
Disciplinary Action is defined as warnings or suspensions given to any member who breaks the Code of Conduct. Disciplinary Action can be initiated in several ways: 

1. Player Initiated: Any member can initiate a complaint against another member of the league by emailing the league commissioner ([email protected]). The complaint should include the player’s name, details of the event, and any witnesses present. 

2. Board Initiated: Upon witnessing an incident or by being briefed by someone with firsthand knowledge of the situation, a manager shall notify the league commissioner to start the process. Complaints will be handled in the following manner: 

* ●  All parties involved will be notified that a formal complaint has been received. The full complaint will be shared with all parties involved and the local Board of Directors. 

* ●  All members involved in the complaint and any witnesses will be able to submit a statement for the investigating committee to review. 

* ●  The investigating committee will review all evidence collected and present their decision to the full board of directors for an up or down vote. 

* ●  Once a final decision is made, all parties will be notified via email provided through registration of the decision. Only that player’s team captain and the board will have access to the decision. 
Spectators 
When a spectator or other non-player is found to be in violation of the Code of Conduct, that person will be asked to cease the offensive behavior. If they fail to comply with that request, they will be asked to leave the site. If the person in question refuses to leave, steps will be taken up to eject them, up to and including referring the matter to law enforcement. 
If the friends/family/fans/supporters of a particular team are found to be in frequent violation of the Code of Conduct, the Umpires, in consultation with League Management, may take further steps, including ejecting the team from playing for the day, resulting in a forfeit or forfeits. 
Continued violations of the Code by a team and/or their supporters may result in ejection from the League for the season. 

* Noisemakers/Distractions 
The use of noisemakers, including but not limited to blow horns, cowbells, sirens, and megaphones, whether by players or spectators is not allowed. 
The use of speakers for ambient music is permitted, however the use of speakers to play excessively loud music, sound effects, or otherwise objectionable material for the express purpose of distracting/demeaning players is not allowed.
